Critical Commentary
Similar to the previous slide, New Jersey as well most recently developed the Environmental Justice Law. This major piece of legislation is first of its kind in that it allows a municipality to deny a permit to a facility if it fails to ensure or comply with regulatory requirements in communities designated as overburdened. The front line communities in this legislation are inherently protected, as during the approval, application process, new industry has to prove mitigation strategies.
